CONDITIONS GENERALES DE VENTE

ARTICLE 1. APPLICATION OF THE GENERAL SALES CONDITIONS

The present general sales conditions are applicable to all products sold by NATURAMI. They are applicable for all contracts signed between NATURAMI and its clients in France or abroad, whatever the delivery address happens to be. No exceptions to the present conditions will be allowed without the prior permission and approval of NATURAMI. All conditions contrary to the present conditions, in the general purchasing conditions or any other document, will not be taken into account by NATURAMI, no matter when they were informed about their existence. These general conditions constitute an essential element in accepting to do business with NATURAMI. They wish to maintain these conditions as long as possible. Nevertheless, NATURAMI reserves the right, at anytime and without notice, to modify the present conditions.

ARTICLE 2. ORDERS

The contractual information on NATURAMI’s website is presented in French and English. The prices do not include tax and are automatically calculated according to the nature of the product just before the order is confirmed. The client can, at any moment, modify his order as long as he hasn’t paid. He has the possibility, after having signed in, to consult orders and estimates that he has consulted by clicking on “Your account”. All orders validated by the Client on NATURAMI’s website are systematically confirmed by e-mail by NATURAMI. However, the estimated delivery time in article 4.2 will only start after the bank transfer has been received.
Orders will by processed according to NATURAMI’s availability. In the case where a product is unavailable, we promise to reimburse the Client 30 days at the latest from the time he pays. After that, these sums are exposed to the current legal interest rates

ARTICLE 3. PRICES

3.1 The selling of works with canvas supports.
The prices include: Exclusive of tax for a delivery to France or any other destination.

The customs duties and other import taxes on merchandise are to be paid by the addressee upon receipt of his order. It is the Client’s responsibility to find out from the local authorities the necessary information and specific formalities concerning importing merchandise from foreign countries.
 
ARTICLE 4. MODES OF DELIVERY

4.1 Addresses and Delivery Locations

All products are delivered to the location specified by the Client on the online order. We strongly recommend that you, before validating your order, verify your delivery and billing address as well as any other information necessary to the carrying out of the transaction.  

4.2 Delivery time

For deliveries to France and other international deliveries: 3 to 4 weeks.

The estimated delivery times mentioned above are valid for all orders made by the Client before 8:00pm local time in New Caledonia from Monday to Friday, not including holidays. The delivery time includes the preparation and the sending of the package. It is only an estimation. If the delivery is late or if we run out of stock, NATURAMI will not be held responsible.

The estimated delivery time mentioned in article 4.2 will start the day we receive your bank transfer or payment.

4.3 Shipping fees

Shipping fees (included) cover the packaging and stamping of the package. These inclusive rates are partly fixed and partly variable, depending on the number of articles ordered and the geographical zone selected by the Client.

PS: We recommend that you order all your articles at the same time. Otherwise you will be charged separately for each order.
 
ARTICLE 5. BILLING / PAYMENT

Bills are payable by :

1. Credit Cards (Carte Bleue, Visa, Eurocard/Mastercard). The payment is debited as soon as the order is validated online.

2. Bank transfers made out to NATURAMI. Please don’t forget to put your name and contact information, as well as the order number which is given to you online and confirmed by e-mail after your order is made. 

If you pay by bank transfer, your order will not be processed until we receive the transfer.

ARTICLE 6. SECURE PAYMENT

6.1 Your banking information is secured by a system of cryptography. Your banking card and expiration date are encrypted and do not circulate on the internet.

6.2 NATURAMI uses the best security system on the market to ensure that your information remains confidential. We also have an alarm system at our disposal.

ARTICLE 7.  RETRACTING PRODUCT

7.1 Products

The client has 7 days from the day he receives his order to retract the product, without having to justify his choice. If the seventh day happens to fall on a Saturday, a Sunday, or a holiday, it will be extended to the next work day. This does not include penalty fees. The product must be returned right away before the time limit mentioned to :

Return fees are the client’s responsibility.

ARTICLE 8.  RETURNING PRODUCT

The client has the possibility, according to article L 121-16 of the consumer code, to return (at his expense) the product to the supplier within seven days after receiving it. He can either exchange it or be reimbursed without any penalties.

8.1 Returning conditions :
No return will be accepted unless it has been previously approved and accepted by NATURAMI within seven work days. This request must be made by fax or e-mail and must mention :
- The delivery or bill number,
- The product reference number and the quantity,
- The reason for the request,
- The condition and the series number of the product,

The client must include with the returned products :
- A return number provided by NATURAMI
- A photocopy of the delivery form.

Returns will only be authorized in the following cases:
- If the product delivered was not the product ordered by the client, or if too many products were sent ;
- If the product has fabrication defects as mentioned in the above conditions, and has been approved by NATURAMI.
The client will return, at his expense, the complete and original package with its user manuals, accompanied with a photocopy of the delivery form and the return number. No return will be accepted after 8 days from the date where NATURAMI gives its permission and approval.

ARTICLE 9. PROPERTY RIGHTS

NATURAMI reserves the right to keep sold products until the complete payment of the ordered product. If the payment is not made, NATURAMI may keep the product. NATURAMI can also take back products that have not been paid for, or demand direct payment. If payment is not made, NATURAMI may demand that the products be returned. Until the payment has been made, our products may not be used as collateral and may not be exchanged or transferred. If the merchandise is given to a third party, and payment has not been made, the client will be charged the full price of the product. If a legal problem comes up, the buyer commits to establishing with NATURAMI an inventory report on the said product. If this is not possible, NATURAMI may have its inventory checked by a bailiff. If there is a partial payment, there will be late fees and interest payments.

ARTICLE 10 : APPLICABLE LAW – JURISDICTIONAL COMPETENCES

French law applies here, with the exception of the Convention of Vienna of 1980. For any differences of opinion relating to the present contract, please refer to the Paris Court of Commerce. For any difference of opinion with a Client, please refer to the laws in place in the Client’s country.

ARTICLE 11 – NOMINATIVE INFORMATIONS

Your personal information and data are necessary to process your order. They may be shared or transmitted to services necessary to the carrying out of your order. This information is kept for security reasons in order to respect legal obligations. This allows us to improve and personalize the services we offer you and the information we give you.

According to the computer law of January 6th 1978, you have the right to access and rectify your personal information. All you need to do is contact our Customer Service department online and give us your first and last name, e-mail address, home address, and if possible your customer reference number.

ARTICLE 12 – INTELLECTUAL PROPERTY

All texts, commentaries, works, illustrations and images on NATURAMI’s website are reserved to NATURAMI. According to the Intellectual Property codes, only very restricted private uses of our intellectual property are authorized (see code and contact us). Any partial or total reproduction of the NATURAMI website is strictly forbidden.
